1.Significance of these Travel Conditions

This trip is arranged by ConciergeBANK,CO., LTD (hereinafter referred to as “the Company”), and the customer participating in this trip shall conclude a contract for an arranged tour (hereinafter referred to as “tour contract”) with the Company. This document will be treated as the Explanatory Document for Terms and Conditions delivered to the customer in accordance with Article 12–4 of the Travel Agency Act, and if a tour contract is concluded, as part of the Contract Document in accordance with Article 12–5 of the same law and Article 10–1 of our General Travel Conditions for Arranged Tour Contract. The contents of the tour contract which the customer intends to conclude shall be as described in this documents and “Arrangement Trip Application Form (and Explanatory Document for Terms and Conditions)”.

2.Contract for an arranged tour

• (1)

  At the request of the customer, we will undertake to arrange for the provision of transportation, accommodation, and other services related to the tour (hereinafter referred to as “tour services”) provided by transportation and accommodation facilites, etc., to the customer by acting as agent, intermediary, or agent for the customer, etc.

• (2)

  In making arrangements for the tour, the Company shall charge the fare, charges and other expenses to be paid to the transportation and accommodation facilites, etc. (hereinafter referred to as “tour expenses”), as well as the prescribed handling charge.

• (3)

  When we have arranged travel services with the care of a good manager, our obligation under the arranged tour contract shall be terminated even if we are unable to conclude a contract with a transportation or accommodation facilites, etc. due to reasons such as full capacity, absence from work, or unsuitable conditions.

3.Travel type

Travel can be categorized into “domestic” travel, which is travel within Japan only, and “international” travel, which is travel outside of Japan.

4.Application for a tour contract

• (1)

  The customer who wish to apply for an arranged tour contract for airline tickets, accommodation tickets, etc. at the request of the customer shall fill in the prescribed items on the Company’s prescribed application form etc., and submit it to the Company together with an application fee in an amount separately determined by the Company.

• (2)

  Notwithstanding the provisions of the preceding item, a customer who wishes to conclude a communications contract with the Company must notify the Company of his/her membership number and other items designated by the Company using an application form, etc. prescribed by the Company.

• (3)

  When a travel application is made by a person responsible for the contract as a representative of a group of customers, the Company shall deem that the contract representative has all the rights of representation regarding the conclusion and cancellation of the travel contract. We may ask you to submit documents proving the identity of the person responsible for the contract within the group or a letter of attorney from the member of the group to prove that the contract representative has been designated by a customer who is a member of the group (hereinafter referred to as “member”).

• (4)

  The contract representative must submit a list of participants to the Company by the date determined by the Company.

• (5)

  The Company will not be responsible for any debts or obligations that the contract representative has already incurred or may incur in the future to the participants.

• (6)

  If the contract representative does not accompany the group, we will consider a preselected group member to assume the role of the contract representative once the tour begins.

• (7)

  Those with health problems, those who use wheelchairs or other equipment, those with physical or mental disabilities, those with food or animal allergies, those who are pregnant or may become pregnant, those with assistance dogs for the physically disabled (guide dogs, hearing dogs, service dogs), or those who need special consideration are kindly requested to inform us of their specific needs at the time of application. (Please also notify us immediately if you develop any of these conditions after the tour contract has been concluded.) We will comply with the request to the extent possible and reasonable. If it is not certain that the Company will be able to take the measures requested by the passenger, or if there are doubts about the passenger’s eligibility to enter the destination country, the Company may refuse the application for the tour contract or cancel the tour contract. In addition, the cost of any special measures taken by the Company for the customer based on the customer’s request shall be borne by the customer.

5.Refusal to conclude a travel contract

Any one of the folowing is a case upon which we reserve theright to decline the execution.

• (1)

  In cases where there is an inconvenience related to our business.

• (2)

  When a communication contract is to be concluded and the customer is unable to settle all or part of the liability related to his or her tour price as stipulated in the card membership rules of the affiliated company due to the invalidity of the credit card held by the customer, etc.

• (3)

  The customer falls under any of the following (ⅰ) through (ⅳ).

  • (ⅰ)

    When a customer is recognized as a gang member, a semi-gang member, an associated gang member, a person or company related to crime syndicates, a corporate racketeer or any other antisocial forces.

  • (ⅱ)

    The customer has made violent demands, unjust claims, threatening statements or violence in connection with transactions, or other acts or behavior equivalent to these against the Company.

  • (ⅲ)

    The customer committed acts which may damage our reputation or obstruct our business by spreading false rumors, the use of fraudulent means or by force, or other acts or behavior equivalent to these.

  • (ⅳ)

    In the case of the offer mentioned in item (5) of the preceding paragraph, when it is not certain that necessary measures can be taken for your participation, or when there is uncertainty as to whether or not you will be able to enter the country of destination.

• (4)

  When the customer is a minor (under 18 years of age) at the time of application and has not submitted a written consent from a person with parental authority (in principle, his/her parents).

6.Time of conclusion of travel contract

• (1)

  The tour contract is established when the Company accepts the contract and receives the application fee.

• (2)

  When concluding a contract with a contract representative, the Company may, by special written agreement, accept an application for a contract without receiving payment of an application fee. In this case, the tour contract will be concluded at the time of delivery of such special written agreement.

• (3)

  The application fee shall be applied to the tour fee, cancellation fee, and any other money the customer pays to the Company.

• (4)

  Notwithstanding the provisions of paragraph (1) above, the Communication Contract shall be deemed to be concluded when we issue a notice of acceptance of said application upon receipt of your notice of acceptance, and said notice reaches you.

7.Delivery of contract documents

• (1)

  Promptly after the conclusion of the arranged tour contract, the Company shall deliver to the customer a contract document describing the tour itinerary, contents of tour services, tour fee and other tour conditions, and the Company’s responsibilities. However, when the Company delivers a document indicating the right to receive tickets, accommodation vouchers, or other travel services for all the travel services to be arranged by the Company, the Company may not deliver such a contract document.

• (2)

  In the event that the Company delivers the Contract Document, the scope of tour services that the Company is obligated to arrange under the arranged tour contract shall be as set forth in the preceding item of the Contract Document.

8.Time of payment of tour fee and change of tour fee

• (1)

  The customer will be required to pay the Company the amount of the tour fee (the tour fee and the Company’s handling charge), on or before the date stated in the contract document.

• (2)

  Even after the contract has been concluded, if there is a change in the cost to be paid to the transportation and accommodation facilities to be used due to a revision of applicable fares and charges or fluctuations in exchange rates, etc., the Company may increase or decrease the tour fee by the amount of such difference.

• (3)

  In the event that the actual cost of the tour does not match the amount of the tour fee collected, the Company shall settle the amount of the tour fee promptly after the completion of the tour.

• (4)

  In cases where we have stated in the Contract Document that the tour price varies with the number of persons utilizing the transportation and accommodation facilities, etc., and when the number of persons participating in the tour changes due to the causes not attributable to us after the execution of the tour contract, we reserve the right to change the amount of the tour price as described in the Contract Document.

9.Alternation of Contract Content

When a customer requests changes to the contents of the contract, the Company will comply with the customer’s request to the greatest extent possible. In such cases, the Company may change the tour fee. In addition, the following charges will apply:

• (1)

  Cancellation and penalty fees to be paid to transportation and accommodation agencies for changes (including refund fees in case tickets have already been issued).

• (2)

  Change procedure fee as specified by the Company.

10.Right ti Cancel the Contract

• (1)

  Customer’s voluntary cancellation

  The customer may cancel all or part of the tour contract at any time by paying the following charges

  • (ⅰ)

    Expenses for tour services received by the customer

  • (ⅱ)

    Cancellation fees for unprovided tour services and other unpaid fees of service providers

  • (ⅲ)

    Arrangement fees and cancellation processing fees as the Company’s prescribed travel service handling fees

• (2)

  Cancellation due to reasons attributable to the customer

  • (ⅰ)

    The Company may cancel the reservation if the payment of the tour fee is not received from the customer by the designated date.

  • (ⅱ)

    If the customer wishes to pay by credit card and the credit card company is unable to settle the payment, the Company will cancel the tour contract.

  • (ⅲ)

    When it is found that the customer falls under any of the items (3) (ⅰ) through (ⅲ) of Paragraph 5. In this case, the following expenses shall be borne by the customer.
    The cost of travel services already received, cancellation fees for unprovided travel services and other unpaid costs of the travel services and the providing agency, and arrangement fees and cancellation processing fees as the Company’s prescribed travel service handling charges.

• (3)

  Cancellation due to reasons attributable to the Company

  If it becomes impossible to arrange the tour services due to the responsibility of the Company, the customer may cancel the tour contract. In such case, the Company will refund the balance of the tour fee after deducting the expenses already paid or to be paid for the tour services already provided from the tour fee.

11.Responsibility of Our Company

• (1)

  The scope of our responsibility is limited to the acts of arrangement described in Section 2.

• (2)

  In the execution of the travel contract, we will be responsible for the compensation of damages caused to the customer intentionally or negligently by us or by our agent (hereinafter referred to as the “Business Agent”) who has been engaged by us to make arrangements on our behalf. Such compensation shall be limited to cases where notice has been given to us within two years from the day immediately following the day when the damages occurred.

• (3)

  In cases where the customer has suffereddamages due to any of the following reasons, we will not be responsible as described in this paragraph (1).

  • (ⅰ)

    Acts of God, acts of war, civil commotion, or changes in itinerary or cancellation of the trip caused by such reason.

  • (ⅱ)

    Damage caused by accident or fire in transportation and accommodation facilities, etc.

  • (ⅲ)

    Cancellation of services provided by transportation or accommodation facilities, etc., or changes in itinerary or cancellation of the trip caused by such services.

  • (ⅳ)

    Orders from government and other public agencies, or changes in itinerary or cancellation of the trip caused by such orders.

  • (ⅴ)

    Food poisoning

  • (ⅵ)

    Theft

  • (ⅶ)

    Delays, cancellations, schedule changes, routing changes, etc. of transportation facilites, or changes in itinerary caused by such reason.

  • (ⅷ)

    Damage caused by the customer’s own willful misconduct or negligence

  • (ⅸ)

    Damage due to any other reason beyond the control of the Company or Business Agent

• (4)

  With regard to damage caused to baggage, we will compensate the customer up to ¥150,000 as a maximum amount per customer (except in cases where the admages have been caused by us intentionally or by our gross negligence), only in cases where we have been notified of the damages within 21 days from the day immediately following the day when the damage has occurred.

12.Responsibility of the Customer

• (1)

  In the case that we have suffered damages due to the willful misconduct or negligence of the customer, the said customer will be required to compensate us for the damages.

• (2)

  The Customer shall make use of the information provided by the Company and endeavor to understand the rights and obligations of the Customer and other details of the tour contract.

• (3)

  Should the customer realize that the tour service being offered differs from that as stated in the Contract Document after the start of the tour, the customer will be required to report promptly to us, our Business Agent, or the provider of the said tour service at the location that is being toured. The name, address, contact telephone number, etc. of the Company’s arrangement agent will be provided in the Contract Document.

13.Non-application of special indemnities provisions

The special indemnities provisions in the separate sheet of the Company’s General Conditions of Tour Business shall not apply to this tour contract.

14.Travel conditions by communication contract

• (1)

  The Company may conclude a travel contract by telephone, e-mail, facsimile, Internet or other means of communication (hereinafter referred to as a “communication contract”) on the condition that the Company receives payment of a portion of the tour fee (application fee), etc. without the Member’s signature from a credit card member (hereinafter referred to as a “Member”) of a credit card company with which the Company is affiliated (hereinafter referred to as a “Partner”). However, there may be cases in which the Company cannot accept such a contract due to the absence of a merchant agreement, including a special agreement for unsigned handling, with a partner company, or for other business reasons.

• (2)

  When applying for a communication contract, the Member shall provide the Company with the “card name”, “membership number”, “card expiration date”, etc. in addition to the “contents of the arranged tour” and “departure date”, etc. for which the Member is applying.

• (3)

  A communication contract shall be deemed concluded when the Company’s notice of acceptance of the contract reaches the customer.

• (4)

  The “card use date” for a communication contract is the date when the Member and the Company should fulfill payment or refund obligations for the tour fee, etc. based on the arranged tour contract, and in the case of the former, it is the date when the contract is concluded, and in the case of the latter, it is the date when the request for contract cancellation is made.

• (5)

  If the customer wishes to pay by credit card and the credit card company is unable to settle the payment, the Company will refuse the application.

15.Tasks to be completed by the customer prior to departure

• (1)

  Procedures for Passport or/and Visa etc.

  It is the responsibility of the traveler to obtain a passport (if you currently have one, please check if it is valid for this trip), visa, and other travel procedures. If the destination country/region requires a vaccination certificate, it is the responsibility of the passenger to bring the certificate.

• (2)

  Hygiene Information

  For information on the hygiene conditions at your destination, please visit the Ministry of Health, Labour and Welfare’s Quarantine and Infectious Disease Information website.

• (3)

  Overseas Hazard Information

  Depending on your destination, the Ministry of Foreign Affairs of Japan may issue travel advisories for the country or region you are visiting, such as “Overseas Travel Safety Information”. Please check the following for details.

• (4)

  Travel Insurance

  If you are injured while traveling, you may incur significant medical and transportation expenses. In addition, you may be required to pay compensation for damages or compensation in an amount that is difficult to recover from the offender. We recommend that you purchase a sufficient amount of domestic travel accident insurance or overseas travel insurance to prepare for such cases. 16.Items prohibited or restricted from being brought into Japan

The following are examples of items that are prohibited or restricted from being brought into Japan. Violation of these regulations may result in punishment under the Customs Law, etc., or orders to relinquish ownership, disposal, or return shipment.

• (1)

  Examples of animals, plants and their products in conflict with CITES

  Certain herbal medicines (musk deer, bear bile, etc.), fur, ivory work, ivory seals, leather goods (crocodiles, snakes, lizards), musical instruments made of animal skins (kokyu, etc.), live animals and plants (monkeys, parrots, eagles, hawks, orchids, cactus, etc.)

• (2)

  Examples of goods prohibited for import into Japan

  Opium, cocaine, stimulants, etc., firearms, explosives, etc., counterfeit goods, imitation goods, etc., child pornography, books, etc. that are injurious to public morals and public safety, counterfeit brand goods, certain animals as specified in the Domestic Animal Infectious Disease Control Law, plants as specified in the Plant Quarantine Law

17.Handling of Personal Information

• (1)

  When accepting a travel application, we will collect the customer’s personal information, including their name, gender, age, address, telephone number, email address, passport number, and other specified details. It is at the customer’s discretion to choose which items of personal information to provide. However, if the customer does not provide all or part of the required personal information, and this could hinder our ability to communicate with the customer, make travel arrangements, and facilitate the provision of travel services, it may not be possible for us to accept their application or fulfill their request.

• (2)

  The Company will use the personal information obtained in accordance with the preceding item for the purpose of communicating with the customer. Additionally, we will provide the personal information obtained in accordance with the preceding item, as well as personal data related to the passenger’s flight details, to transportation and accommodation agencies, service providers, insurance companies, souvenir stores, government agencies, etc., by sending such data by electromagnetic means, etc. in advance. This will be done to the extent necessary for the procedures for arranging and receiving the transportation, accommodation and other travel services (the main transportation and accommodation facilities, etc. are described in the itinerary or Determinate Document) for the trip applied for by the customer, to the extent necessary for insurance procedures to cover the Company’s liability under the tour contract and expenses in the event of an accident, to the extent necessary for the convenience of customers shopping at souvenir stores in the destination, to the extent necessary for the registration of customers on the platform of the Japan Tourism Agency such as “Tour Safety Net” etc. In addition, the Company may use personal information for the following purposes: (ⅰ) to provide information about the Company and its affiliated companies’ products, services, and campaigns, (ⅱ) to request feedback and opinions after participating in a trip, (ⅲ) to request surveys, (ⅳ) to offer special services, (ⅴ) to create statistical reports, (ⅵ) to develop and enhance products or services, (ⅶ) to provide advertisements related to new products and services tailored to your interests and preferences by analyzing acquired information such as browsing history and purchase history.

• (3)

  In case of illness or accident during the trip, we will ask for the personal information of the contact person of the customer during the trip. This personal information will only be used by the Company when it deems it necessary to contact the designated person in the event of illness, etc., of the passenger. The customer is responsible for obtaining the contact person’s consent to provide their personal information to the Company.

• (4)

  We may outsource part or all of the operations handling personal information acquired in accordance with the paragraph (1) of this section to other companies in the course of providing services such as arrangement agency services, travel accompanying services, and other on-site services at airports etc. In such cases, we will select such outsourcing companies in accordance with our standards, and will entrust personal information to them after signing a confidentiality agreement with them.

• (5)

  We will share the limited set of your personal data necessary for contacting you, including your name, address, phone number, or email address, with our group companies among the personal data we possess. The group companies concerned may use this information for their own business guidance, simplifying your applications, providing event details, and facilitating the delivery of purchased products. Please refer to our website for the names of our group companies with which we share your personal data and the group companies responsible for managing personal data (contact point for requests regarding disclosure, correction, deletion, etc., of personal data).

• (6)

  The Company shall promptly respond to requests from customers for notification of purpose of use, disclosure, correction, addition, deletion, suspension of use, elimination, or record of provision to a third party.

• (7)

  We will not handle personal information beyond the scope necessary to achieve the purpose of use without the prior consent of the customer, except as permitted by the Personal Information Protection Law and other laws and regulations. However, changes to the purpose of using personal information shall be made only when it is reasonably determined to be related to the previous purpose of use. In the event of a change in the purpose of use, the Company will notify the customer of the revised purpose through the method established by the Company or publicly announce it on the Company’s website.

• (8)

  In the following cases, the Company may share personal information with third parties located in foreign countries (referring to countries or regions outside of Japan), including subcontractors and joint users. We will provide personal information such as customer name, gender, age, address, telephone number, email address, passport number, other personal information such as service usage, site browsing history, product purchase history, location information, etc. by sending it by electronic means, as needed, for the arrangement and receipt of the travel services requested by the customer, for providing other products and services, for insurance procedures to cover the Company’s liability under the travel contract and accident expenses, and for the convenience of customers shopping at souvenir stores in the destination. Please refer to our Privacy Policy for information on the protection of personal information at the destination in the relevant foreign country (please check the name of the specific country or region in the itinerary, etc.).

• (9)

  In addition to the above, please refer to the Company’s website for the Company’s privacy policy.

18.Others

• (1)

  If any expenses are incurred due to injury or illness of the passenger, loss of luggage or recovery of lost items due to the carelessness of the passenger, or expenses incurred in making arrangements for separate excursions, the passenger shall bear such expenses.

• (2)

  For your convenience, we may take you to souvenir stores, but you are responsible for your purchases. We will not be able to assist you in exchanging or returning merchandise. If duty-free refunds are available, please be sure to have your purchases in your carry-on luggage, and please check with the souvenir store, airport, etc. to confirm the procedures for such refunds. As mentioned in section 16, some items are prohibited from being brought into Japan under the Washington Convention and other domestic laws and regulations, so please be careful when making purchases.

• (3)

  In the case of local tours, the responsibility of the operator and the responsibility of the customer shall be based on the provisions of the operator and local laws and regulations.

• (4)

  The Company will not re-perform the trip under any circumstances.

• (5)

  The use or resale of rooms reserved through this arrangement for commercial purposes is strictly prohibited. In the unlikely event that the Company determines that such an act is for the purpose of profit-making or preparation, the arranged tour contract may be cancelled without prior notice.

19.Compliance with the General Terms and Conditions

• (1)

  Matters not described in this written explanation of travel conditions shall be in accordance with the Company’s General Terms and Conditions for the Travel Business (Arranged tour contract section). If you would like to receive a copy of the Company’s Travel Business Terms and Conditions, please request it from the Company. You can also find our Travel Business Terms and Conditions on the Company’s website.

• (2)

  The terms and conditions of the travel service providers, including transportation and accommodation facilities, shall be applicable to the travel services provided to the customer during the tour.

20.Main Text, Applicable Law, and Agreed Jurisdictional Court

• (1)

  The original text of these Travel Conditions and other documents related to the tour contract shall be in Japanese. For the convenience of the customer, the Company may translate some or all of these documents into other languages for the customer’s reference only, and in the event of any conflict between the Japanese version and the translated version, the Japanese version shall take precedence over the authentic text.

• (2)

  The travel contract between the Company and the customer shall be governed by and construed in accordance with the laws of Japan.

• (3)

  The Tokyo District Court shall be the court of exclusive jurisdiction for any and all disputes between the Company and the customer in connection with the tour contract.
